Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your Account

You sign in to Recollections using your Google account via Google OAuth. You are responsible for maintaining the security of your Google account and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Your Content

Ownership

You retain full ownership of the photos, captions, and other content you upload to the Service (“Your Content”). We do not claim any ownership over Your Content.

License to Us

By uploading content to the Service, you grant us a limited, non-exclusive, royalty-free license to store, display, and process Your Content solely for the purpose of providing the Service to you — including generating print-ready files if you place a print order.

The license granted to us in this section does not include any right to use Your Content for AI or machine learning training purposes.

Your Responsibility

You are solely responsible for the content you upload. You represent and warrant that:

• You own or have the rights to all content you upload
• Your content does not infringe any third party's intellectual property, privacy, or other rights
• Your content does not contain illegal material, including but not limited to content that is defamatory, obscene, or violates any applicable law

We reserve the right to remove content that violates these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content you do not have the right to share
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate another person or entity
• Upload, share, or attempt to print any illegal content, including but not limited to child sexual abuse material (CSAM)
• Use, scrape, download, or otherwise extract any content from the Service — including albums accessed via share links — for the purpose of training, fine-tuning, or developing artificial intelligence or machine learning models

5. Content Moderation and Illegal Content

We use automated content moderation tools to screen all uploaded photos for illegal content, including child sexual abuse material (CSAM), prior to storage. Any account found to have uploaded illegal content will be immediately and permanently terminated.

We are required by federal law (18 U.S.C. § 2258A) to report any known or suspected CSAM to the National Center for Missing and Exploited Children (NCMEC). By using the Service, you acknowledge and consent to this screening process.

6. Print Orders

When you place a print order through the Service, your order is fulfilled by Lulu Direct, our print-on-demand partner. By placing an order, you also agree to Lulu Direct's terms of service. Payment is processed by Stripe.

All print orders are final. Due to the custom nature of photo book printing, we do not accept returns or offer refunds except in cases of manufacturing defects or errors on our part. If there is a problem with your order, please contact us within 14 days of receipt.

7. Sharing Features

The Service allows you to generate shareable links to your albums. When you share an album link, you are making that album's contents accessible to anyone who has the link. You are responsible for deciding what you share and with whom. We are not responsible for how recipients use or share your link.

8. Intellectual Property

The Service, including its design, code, and features (excluding Your Content), is owned by Recollections and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express written permission.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECOLLECTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Recollections and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time and may delete your account from within the app. We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. We will handle your data as described in our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
